Complaints & Disagreements
Whilst the majority of complaints are from members of the public who are dissatisfied with some facet of their dealings with a member, there are also a number of occasions when two members are in disagreement about aspects of their relationship. When you are admitted to membership of the PTS you are given, and agree to accept, a Code of Ethics, (drawn up by the Membership). Naturally, you are entitled to expect assistance from the Society when you feel that some transgression of the Code affects you.

Initially, complaints are received by the Secretary who may sometimes be able to suggest a compromise solution. Normally however, the complaint is passed to the Business Practices Committee (BPC) for consideration. The composition of the BPC may vary according to the individual case, but will always be drawn from Council. It will include at least one of the Officers with the remainder chosen from the Council to give a wide spread of trading experience and informed opinion. The committee meets on a regular basis, the frequency depending inevitably on the nature and urgency of the business in hand.

In the majority of cases the BPC will rule on the matter in accordance with the Code of Ethics, but it may, where it feels that a fresh view of a difficult problem may be needed and a definitive solution sought, refer the matter for deliberation by the full Council, or suggest arbitration. Either party may at any time ask for arbitration, following a BPC or Council ruling.

The Arbitration Committee comprises a regular Chairman, nominated by, but not necessarily a member of, the PTS Council, the Chairman of the BPC and such other member(s) as is deemed necessary or advisable to ensure a fair and unbiased result. Obviously, both sides sign an agreement to accept the Arbitration Committee's final decision and the case is examined thoroughly. If there is a legal position to be considered, the parties will be advised to seek a Solicitor's advice, but that apart, the Committee will make a ruling which settles the matter in the most equitable way.
